EA’s Indifference on Record Here & Now

It depresses me to have to put this down “on record” of sorts. If anyone has been following us here, you’re aware that there was a serious incident that happened a couple months ago involving a claim of possible child abuse reported to Maxis (See Below “Challenge Everything:” and comments). It bothered me greatly and raised some difficult questions in my mind about the privacy policy of Electronic Arts. I don’t expect them to remedy the difficulties of the world; indeed I acknowledge their *possible* position in my article- that they can’t help to stop third-party harms given the lack of channels available to them to do so. The problem is not just theirs to solve, but they must be a part of finding a solution to it (if we *all* care to try). I thought a dialogue with EA might be a good way to start, and might help me to better understand their position. Yet, I’ve tried repeatedly to contact them over months with not a whisper of a response. They apparently are so indifferent towards this issue that they can’t bother to reply in any way. Silence was the only reply I received; no attempt at clarification let alone justification. So, here is my last correspondence with them (is it correct to call unilateral communication correspondence? No; I guess, this is my latest plea to them). I just want to post it to stand as a public monument to their indifference on this issue. Draw whatever implications from it that you will, but I feel it may interest a few and I think I’m morally obliged to set it down in writing for whomever cares to read it. The following was my last e-mail to the privacy administration division at EA:

This is one of several attempts to get a response to an important inquiry regarding your privacy policy and an incident that was brought to my attention through The Sims Online. Failure to respond to my inquiry this time will result in a final conclusion in a public forum that your company is indifferent to this situation. In light of your previous failures to respond, despite patience and charity, I can come to no other reasonable conclusion.

To recap what is now common public knowledge, Dr. Peter Ludlow contacted me about a disturbing situation he encountered on TSO, which I also play. A player reported to him, outside the context of role-play, that he had been abusing his sister (“put her in the hospital” was the basic content of the message). Dr. Ludlow contacted Maxis, who sent him a series of inane form responses. I continue to be extremely disturbed by this situation, and your lack of *any* reply to my concerns. Upon hearing about this incident months ago, I immediately expressed my outrage to you, and told you that I thought this was an unconscionable, misleading, and unacceptable policy.

Upon receiving no further word from you, I contacted you once again, in a more tempered fashion. I decided that it was possible that you had a rationale behind your actions, and I would ask you for it. It seemed to me only fair to give you an opportunity to respond. You failed, once again. No word came to me at all.

So, here I go again. You seem to have a real hard time getting the point of my messages (as did Maxis totally miss the point of poor Dr. Ludlow’s concern, so it appears). This is the point: Your privacy policy indicates that you may release information to civil authorities if you have reason to believe you can help prevent harm from occurring to a third party. Yet, your Maxis division received such notification from Dr. Ludlow, and Maxis told *him* to contact the police if someone he knew was in danger. He did so, even though it was *not* someone he knew, rather it was a game player in TSO and your company is the *only* entity who holds such information to supply to civil authorities. There is a real problem here that we need to address.

What is your explanation for your actions in this case? Why does your privacy policy read the way it does regarding third-party harm when you have no intention of passing on cases of reported abuse that come through game players to a civil authority? If you only mean that you will do so if *compelled* by a law enforcement agency, I suggest you craft that into your privacy policy. Can you please explain your rationale to me on this issue?

Quite frankly, this is a very serious issue and your lack of response is not only exasperating but also sickeningly disturbing. I literally lose sleep over this issue, yet everyone at EA must be sleeping so well (on comfy beds from the money your customers provide to you, it might be noted) that no one can even bother to reply to my inquiry. I’m imploring you to take the time to explain your rationale to me now. The customer is indeed not always right, but doesn’t she at least deserve a reply to a legitimate inquiry? (Most helpfully, you might also explain to me how it takes several attempts over an extended period of time to receive any reply from you).

    If that was an encouraging cheer (rather than a little mocking bemusement at my admittedly naive ideal that a huge company should have to answer to a *mere* customer; maybe a bit of both I suppose), thanks Dr. Ludlow.
    I’ll continue to try to get a response out of them.

    Ok, I don’t play sims online, so maybe there is some aspect to this game I don’t understand… However, it seems to me that this is a roll playing game. I’m not 100% sure you would be able to tell when someone was, or was not in their roll. Perhaps this sim had a dual personalty? Maybe this sim’s personatly was to be crazy. Maybe they were some sort of brain alien.

    Also, if someone was putting their sister in the hospital, it’s safe to say that this should be delt with in that hospital.
